Penal Code Section 470(a) states that every person who alters, falsifies, forges, duplicates or in any manner reproduces or counterfeits any driver’s license or identification card issued by a governmental agency with the intent that such driver’s license or identification card be used to facilitate the commission of any forgery, is punishable by imprisonment in the state prison, or by imprisonment in the county jail for not more than one year. Penal Code Section 470(b) makes it illegal to possess or display any falsified identification with the intent to use the falsified or forged identification to commit forgery.
This is applies to any changes made to any government issued identification card, not just a California issued identification card. Most commonly, people are charged with this offense because they change the date of birth on a driver’s license or identification card, typically to show the person with the identification is 21 years of age or older.
