Residential Burglary is commonly referred to as First Degree Burglary and is a felony. You commit residential burglary if you enter the home or inhabited dwelling of another person with the intent to steal or commit a felony.
An inhabited dwelling refers to where one would sleep or live, such as an attached garage to a house, a balcony attached to a house or residence, a hotel room or other similar places. An inhabited dwelling does not have to be currently occupied.
